Shipowner vs Ship Operator vs Disponent Owner: What Is the Difference

Several companies can stand behind one ship. This page explains who is who: the registered shipowner, the ship manager, the ship operator and the disponent owner.

The shipowner

The shipowner (also written ship owner) is the company that holds the legal title to the ship. It is named in the ship's registry. A shipowner can own one ship or a large fleet, and often owns each ship through a separate company.

The ship manager

The ship manager runs the ship on a day-to-day basis: the crew, the maintenance, the safety rules and the repairs. The ship manager can be the owner itself or a specialised ship management company hired by the owner.

The ship operator

The ship operator decides how the ship is used commercially: which cargoes it carries, which voyages it makes and which charter parties it signs. A ship operator can be the owner, or a company that has hired the ship from the owner. On Shipfixing the party that offers a ship is called the ship operator, because it is the company that has the commercial right to fix the ship, whoever holds the legal title.

The disponent owner

The disponent owner is the company that, under a time charter, controls the ship commercially and re-lets it to another charterer. The word comes from the Latin for "to dispose": the disponent owner has the right to dispose of the ship's services, although it is not the registered shipowner. The registered owner is then called the head owner. In a chain of charters, the party you deal with as the "owner" is often a disponent owner.

Why it matters to a charterer

The company that signs the charter party with you is your counterparty. If it is a disponent owner, the head owner stays in the background and the contract chain has more links. Ask who the registered owner, the manager and the disponent owner are, check that the party you deal with has the right to fix the ship, and read the clauses about demurrage and liens with care.

Charterer, owner and operator

A charterer hires the ship; the owner, the manager, the ship operator and the disponent owner are the parties on the ship side. See also the how to charter a ship guide.
