Privacy Policy

1. Who We Are
Shipfixing is operated by Comdity LLC, a Florida limited liability company, located at:
7901 4th St N, Ste 300
Saint Petersburg, FL 33702-4399
United States
In this Privacy Policy, “Shipfixing,” “we,” “us” and “our” refer to Comdity LLC when operating the Shipfixing service.
This Policy explains how we collect, use, disclose and retain personal information when you visit our website, register an account, submit a chartering request, provide a vessel offer, communicate with us or otherwise use our services.
Shipfixing is a business-to-business platform. It is not intended for consumers or persons under 18 years of age.
2. Information We Collect
Depending on how you use Shipfixing, we may collect the following categories of information.
A. Account and Company Information
This may include your name, business email address, username if provided, password hash, company name, country, business address, telephone number, logo, avatar, job title, role and company-account relationships.
We may also collect information about invitations, email verification, account status, sign-in activity and the last time an account was used.
B. Chartering Requests and Offers
We collect information submitted through requests and offers, including charter type, vessel type, capacity, loading and discharge ports, laycan or other dates, cargo details, freight or hire indications, vessel selection, estimated arrival information, offer validity and notes.
We also process workflow information such as request status, offer status, negotiation start, Fixed, Failed, No Response, cancellation and related timestamps.
C. Vessel and Business Contact Information
We may process vessel particulars, IMO numbers, vessel positions, ownership or management information, and business contact details obtained from public registers, ship-data sources, AIS-related services, industry sources or users.
Some of these records relate to identifiable individuals, including individual business contacts. Where so, they may constitute personal information.
D. Verification and Support Information
Where applicable, we may collect vessel or company verification documents that you choose to submit, support messages, correspondence, and information necessary to investigate a report or respond to a request.
Please do not submit sensitive personal information or documents that are not necessary for the relevant business purpose.
E. Payment and Subscription Information
Where paid services are available, we may process plan details, subscription status, payment amount, currency, payment status, transaction references and identifiers supplied by our payment processor.
Payment-card details are processed by the payment provider. Shipfixing does not store complete payment-card numbers or card security codes on its own systems.
F. Technical and Usage Information
Our systems may process information needed to operate and secure the service, such as IP addresses associated with requests, session identifiers, authentication and security events (for example failed sign-in attempts, which we count per user name and IP address for a short time to pause repeated guessing), browser or device information where collected, timestamps, and technical logs.
We do not use analytics or advertising tracking on our website. For links in our news emails, see section 6.
3. How We Use Information
We use information for purposes including:
- Creating and administering company accounts and user access.
- Verifying email addresses and managing invitations.
- Receiving, verifying and publishing chartering requests.
- Identifying potentially suitable vessels and distributing relevant requests.
- Receiving, displaying and forwarding vessel offers.
- Sending your company name, personal name and email address to the other party when you start a negotiation with it.
- Managing subscriptions, payments, billing and payment-related support.
- Sending service notifications, verification messages, request alerts, offer updates, reminders and security messages.
- Sending Shipfixing news by email with your consent, as described in section 6.
- Responding to support requests and investigating abuse, fraud or security incidents.
- Enforcing our Terms of Service and complying with legal obligations.
- Maintaining, protecting and troubleshooting the website and service.
We do not sell personal information. We do not use personal information for targeted advertising unless we expressly update this Policy to explain such processing.
4. Chartering Requests, Offers and Disclosure of Contact Details
When a chartering request is active, relevant request information may be made available to potentially suitable registered ship operators. We may also email relevant non-registered ship operators about a potentially suitable request, where permitted by applicable law.
We generally do not disclose the charterer’s identity or direct contact details to vessel recipients before the charterer starts a negotiation.
When you start a negotiation we send your company name, personal name and email address to the other party, so that it can contact you and negotiate directly. The charterer starts a negotiation with Start Negotiation on an offer; the ship operator starts one by accepting a counteroffer with Accept and start negotiation. Next to each of these buttons we say, before you press it, that your details will be shared with the other party. By pressing the button you ask us to take this step and to share these details; we do not ask for a separate tick box. The other party has not started anything yet at that stage, so we do not send its details to you. Only that other party receives your details: never other ship operators or charterers who took part in the same request.
The information disclosed is limited to the company name, the personal name and the email address of the person who started the negotiation. We do not share telephone numbers or other personal contact details at that stage. Whether the charterer acts as a charterer or as a broker is shown in the posting from the start and is not sent again.
Shipfixing does not participate as a party in the resulting commercial negotiations or contract. After contact details are exchanged, each party is responsible for how it uses the information it receives, subject to applicable law.
5. Emails to Non-Registered Companies
To identify potentially suitable vessels, we may use vessel, ownership, management and business contact information from public registers, industry sources and third-party ship-data or AIS-related providers.
We may also send a short introduction email, and up to two reminders, to the business addresses of companies that appear to operate in a trade relevant to Shipfixing (for example cargo owners, traders, charterers and ship operators). We take company names and business contact details from the companies' own websites and public contact pages, public trade and industry sources, public news and event pages, and licensed business-data providers. We record the source and the date. Where applicable data protection law requires a legal basis, we rely on our legitimate interest in offering a business-to-business service to relevant companies, and only where the law allows such emails without prior consent; where prior consent is required we do not send them. Every such email names the sender, links to this Policy and has an unsubscribe link. We keep contact details for as long as they remain relevant to this purpose and stop using them when you object, when they are out of date, or after a period we review regularly. You may object to this use of your data at any time, ask for access or deletion, or complain to your data protection authority, by writing to the contact address in this Policy.
Where permitted by applicable law, we may send relevant ship operators an email about a specific chartering request that appears commercially relevant to their vessel or business. We seek to limit these communications to relevant business purposes and to apply appropriate controls against repeated or irrelevant messages.
Recipients may opt out through the unsubscribe mechanism provided in the email. Where an opt-out applies to a company domain or group of addresses, we may retain the minimum information necessary to honor that choice and prevent further emails.
The fact that a business email address is publicly available does not by itself mean that every use of that address is permitted. Our processing and email practices remain subject to applicable data protection, privacy and electronic-marketing laws.
6. News Emails
We send news emails about Shipfixing only to people who have asked for them: by ticking the optional news box when signing up (or when sending a request or a support message), or on our Shipfixing news page. After a sign-up on a form we first send a confirmation link and start only when you open it. For every consent we keep a record of the time, where it was given, the IP address it came from where we collected it online, and the wording you agreed to, for as long as we need it to show that you asked. We do not send news emails to addresses from bought or rented lists, and we do not send them to free webmail addresses.
Being registered on Shipfixing, confirming a request or writing to our support does not by itself subscribe you to news emails. Our news emails are based on your consent, which you can withdraw at any time. Every news email names Shipfixing (Comdity LLC) as the sender, shows our postal address, links to this Policy and contains an unsubscribe link, which also works with the one-click unsubscribe of email applications. You can also write to info@shipfixing.com. We keep the minimum needed (the email address, the date and the scope of your request) so that we do not email you again, and we stop at once for addresses that bounce permanently or report our email as spam.
Our email delivery provider sends these emails and tells us whether an email was delivered, bounced or reported as spam. We record whether a link in a news email was used; we do not use tracking pixels to record whether an email was opened. The emails you need to use the service (confirmations, requests, offers, payment and security messages, and request notifications to ship operators, see section 5) are separate and continue when you unsubscribe from news emails.
7. Legal Bases for Processing
Where applicable data protection law requires a legal basis, we rely on one or more of the following, depending on the purpose and circumstances:
- Contract or pre-contractual steps: to create and manage accounts, process requests and offers, provide platform functions and administer subscriptions.
- Legitimate interests: to operate and secure a business-to-business matching platform, identify relevant vessels, distribute relevant chartering requests, prevent misuse, maintain records of opt-outs, respond to business enquiries provided those interests are not overridden by the rights and freedoms of the individuals concerned.
- Legal obligations: to meet applicable accounting, tax, legal-process and regulatory requirements.
- Consent: where consent is required by applicable law for a specific processing activity.
Where we rely on legitimate interests, the purpose and circumstances of the processing matter. This does not automatically authorize every form of direct marketing or every email to a non-registered recipient. We will comply with applicable electronic-marketing rules and obtain consent where required.
Where processing is based on consent, you may withdraw that consent without affecting the lawfulness of processing carried out before withdrawal.
8. Who We Share Information With
We may share information with the following categories of recipients where necessary for the purposes described in this Policy:
- Other Shipfixing users: relevant request and offer information, and the company name, personal name and email address of the person who starts a negotiation, to the other party of that negotiation. A deal that both sides mark Fixed is shown on the Fixtures page of those two companies only.
- Hosting and infrastructure providers: to host and operate the website, databases and technical services, and to deliver the site's fonts and scripts.
- Security providers: Google reCAPTCHA, to protect the sign-in, sign-up, request and support forms against automated abuse. When a protected form is used, technical information such as the IP address and browser data is sent to Google, which handles it under its own privacy terms.
- Email delivery providers: to send verification, service, relevant request-distribution and, with your consent, news emails, and to report deliveries, bounces and spam complaints.
- Payment providers: to process subscriptions, payments, renewals, cancellations, refunds and billing-related activity.
- Ship-data and AIS-related providers: to obtain or update vessel information and positions. Where applicable, we may provide IMO numbers or other vessel identifiers needed for the lookup.
- Professional advisers and authorities: where reasonably necessary for legal, accounting, security, compliance or dispute-related purposes.
- A successor or buyer: in connection with a merger, restructuring, financing, sale or transfer of all or part of the business, subject to applicable law.
We do not share personal information with third parties for their own unrelated purposes unless permitted by law or otherwise explained to you.
We will update this Policy when we change these providers in a way that matters for your information.
9. International Data Transfers
Shipfixing is operated from the United States, and certain service providers or recipients may process information in the United States or other countries.
Where applicable data protection law restricts international transfers, we will use a lawful transfer mechanism or safeguard required by that law. The mechanism available may depend on the provider, the destination and the relevant legal framework.
Please contact us if you need further information about applicable international transfer safeguards.
10. Cookies and Similar Technologies
Shipfixing may use cookies or similar technologies that are necessary for the website to function, including session management, authentication, security, CSRF protection and remembering relevant user preferences such as time zone.
These technologies support core functionality and security. We do not use advertising or analytics cookies. The sign-up, request and support forms are protected by Google reCAPTCHA, which sets its own cookies and receives technical information about your visit (such as your IP address and browser) to tell people from automated abuse; Google's privacy policy applies to that processing.
If we introduce non-essential cookies or similar technologies that require consent, we will provide the notices and controls required by applicable law.
11. Data Retention
We retain information for as long as reasonably necessary for the purposes described in this Policy, including operating the service, maintaining account and transaction records, resolving disputes, enforcing our Terms of Service, complying with legal obligations and protecting the platform.
Certain operational periods may apply, including:
- Unconfirmed company accounts may be deleted after 24 hours.
- Sign-up verification links may expire after 7 days.
- Company invitations may expire after 24 hours.
- Homepage request verification links may expire after 48 hours.
- Unused guest accounts may be deleted after 90 days.
- Unpaid requests or vessel registrations awaiting required payment may be removed after 7 days.
These periods relate to the relevant account, link or workflow and do not necessarily mean that every associated record is immediately erased from all systems or backups.
Other account, request, offer, payment, support and technical records may be retained for different periods depending on their purpose, legal requirements, security needs and whether a dispute or transaction remains open.
Where information is no longer required, we will delete it, anonymize it or securely restrict it, subject to applicable law and legitimate retention needs. We may retain limited suppression records to respect unsubscribe requests.
12. Your Rights and Choices
Depending on your location and the applicable law, you may have the right to:
- Request access to personal information we hold about you.
- Request correction of inaccurate information.
- Request deletion of certain information.
- Request restriction of certain processing.
- Object to processing based on legitimate interests.
- Request a portable copy of certain information.
- Withdraw consent where processing relies on consent.
- Lodge a complaint with a competent data protection authority.
These rights are subject to legal conditions and exceptions. For example, we may need to retain certain payment, accounting, security or dispute-related records even if you request deletion.
To exercise a right, contact info@shipfixing.com. We may need to verify your identity or authority before responding. We will respond within the time required by applicable law.
You may also request account closure through this email address. Closing an account does not necessarily erase all information immediately and does not automatically cancel a paid subscription; subscription cancellation may need to be completed separately.
13. Security
We use reasonable technical and organizational measures designed to protect information, which may include HTTPS, password hashing, access controls, role-based permissions, verification tokens, request limits and other security measures.
No website, transmission method or storage system can be guaranteed completely secure. You are responsible for protecting your credentials and promptly reporting suspected unauthorized access.
14. Children
Shipfixing is intended for business users aged 18 or older and is not designed for children. We do not knowingly intend to collect personal information from children through the service. If you believe a child has provided personal information, contact us so that we can review the situation and take appropriate action.
15. Changes to This Policy
We may update this Policy to reflect changes in the platform, our data practices or applicable law. We will revise the “Last Updated” date and provide additional notice where required by law or appropriate for a material change.
